What is mediation?
Personal mediation is a voluntary dispute resolution process that helps you to communicate and negotiate a mutually acceptable agreement. It’s a less formal, confidential, and often more affordable and efficient alternative to court for personal matters like family issues, financial disputes, and community issues.
How the process works
Dispute Identification: The mediator helps the parties clearly identify the issues, their needs, and desired outcomes.
Communication: The mediator facilitates constructive communication between the parties, which may have broken down.
Option Generation: The parties brainstorm and explore various options and solutions to the dispute.
Negotiation: The mediator guides the parties through a negotiation process to reach a solution they can both agree on.
Agreement: If an agreement is reached, it can be formalised into a binding document, depending on the type of dispute.
Benefits of mediation
Control: Parties maintain control over the process and the final outcome, rather than a judge deciding for them.
Affordability: It is typically less expensive than the legal costs associated with litigation.
Efficiency: Disputes can often be resolved more quickly than through formal court processes.
Confidentiality: The process is confidential, allowing for open discussions without fear of statements being used in court.
Flexibility: The focus is on creative and flexible solutions that are tailored to the parties' specific needs.
